This contractual agreement is between , hereafter referred to as "SELLER" and BUYER, hereafter referred to as PURCHASER" for the sale and purchase of one purebred Australian Shepherd.

 

Deposit and Prices: An amount of $500 will be accepted as a deposit to reserve a puppy. With your $500 non-refundable deposit, you show you are serious about owning one of our Miniature Australian Shepherd puppies and you will be assured a spot on our waiting list for our current or next litter. Deposits are nonrefundable/ transferrable once the buyer has reserved a puppy. By submitting a deposit by either check or cash you are agreeing to all terms in this contract and the deposit contract.

 

Prices: Prices start at $1,750. Puppies will be individually evaluated and prices will vary depending on pedigree, markings, and eye color. The buyer when applicable must pay veterinary and transportation costs. In consideration of purchase price and a $500 non-refundable deposit, the breeder transfers in fee simple all rights, privileges and responsibilities associated with the ownership of a MALE - FEMALE dog of the Australian Shepherd breed to Purchaser as of the date and time specified above. This contract represents the entire agreement between Breeder and Purchaser in an (check one) Outright ( ) Co-ownership ( ) Limited Registration þ The Purchaser agrees that they are responsible for all shipping and transportation costs, if applicable, to be remitted to the Breeder prior to the shipping of the dog. Deposits may be placed via certified check, cash, Venmo, Zelle, or Cash App. Certified check or cash must pay the remaining balance if buyer is in state. Venmo, Cash App, Zelle, or Certified Check will be accepted for the final payment in the case of a puppy being shipped out of state.

Payment Plan: Payment plans are not accepted at this time.

Use of the Dog: It is agreed between Seller and Purchaser that this dog is being acquired as a family companion dog or as a working dog to be used for tasks appropriate to its breed. These tasks include herding, search and rescue, therapy, exhibition in conformation, obedience, frisbee, flyball, tracking or agility competition. The dog is not being purchased for resale nor will it be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation. Specifically it will not be used as a guard or attack dog, to hunt or fight other animals, or used in scientific experimental research.

 

Health: The breeder warrants the dog to be in good health as of the time of sale. Further the breeder warrants that both the sire and dam have been administered a full genetic panel by Paw Print Genetics/Canine Health Check and are free from collie eye anomaly, cone degeneration, MDR1, degenerative myelopathy, hereditary cataracts, hyperuricosuria, multifocal retinopathy 1, neuronal ceroid lipofuscinosis 6, and progressive retinal atrophy/progressive rod-cone degeneration, unless otherwise noted in this contract. If any genetic disorder presents itself within 3 years after the purchase date which is sufficiently serious to prevent the animal from fulfilling its represented role to the Purchaser, the Purchaser may: A. Receive a replacement of equal quality at the Sellers discretion from the next available litter. B. Keep the dog and have it neutered or spayed. The Purchaser agrees that all shipping and transportation costs of the replacement puppy are their responsibility and no animal will be shipped without these costs being remitted to the Seller first. Once the dog has been bred under any circumstances, the guarantee will be considered fulfilled and the Seller will be held to no further obligations to the Purchaser. Seller strongly encourages Purchaser to have the dog seen by a Veterinarian of Purchaser's choice within 72 hours of picking up the dog.

 

Registration: The Seller certifies that the dog is eligible for registration under the regulations of the American Stock Dog Registry as a purebred Australian Shepherd and will provide the proper forms for such a registration. The Seller reserves the right to affix the kennel name(s) Rafter 22 and supply a registry name for the dog. No other kennel name(s) shall be affixed to this dog’s registry name. The Seller will be granted limited registration at the time of purchase. If the Purchaser has evaluated the dog at a later date and wishes to be granted full registration for breeding, the Seller will be contacted and provided proof that the dog is sound for that purpose. If permission is granted from Seller, the limited registration will be changed to full registration with the American Stock Dog Registry. Buyer will be responsible for whatever fees are associated with registration.

American Stock Dog Registry - Full or Limited Registration? “Full registration means the dog comes with the right to breed. Dogs on limited registration do not come with that right. If you sell a dog signed over as Full Registration you may not change it after the fact. If you mark a dog as Limited, but decide to give the new owner full rights in the future, you may make that change.”

Ownership Responsibilities: 1. The Purchaser agrees to maintain the dog in a humane environment and properly train and care for the dog. Specifically the dog will be inoculated against rabies, distemper, parvovirus, and other communicable diseases as recommended by a qualified licensed veterinarian. 2. The Purchaser agrees to maintain the dog on a commercial Heartworm preventative on a schedule recommended for the specific region in which the dog will reside. 3. The Purchaser agrees that the dog will not be allowed to roam on neighboring properties and will be secured in a fenced area when unattended 4. The Purchaser agrees to ensure that the puppy will be socialized with other animals and humans. 5. The Purchaser agrees that he/she is not acting as an agent of, nor will the Purchase in turn sell this dog to a pet store, dealer, wholesale outlet; known puppy mills, guard dog business or research facility.

Show/Pet: Due to the numerous circumstances involved in campaigning, maintaining and showing a dog, we will not guarantee that a "Show Quality" dog or puppy will be successful in the show ring as an adult and no warranties are made to that effect. The seller can only estimate the mature size of a puppy based on the size of the sire and dam. The seller makes no guarantee that the puppy will mature to be a certain size.

Right of Recovery/Placement: In the event that the Purchaser is unable or unwilling to keep the dog or provide an appropriate home in accordance with this agreement due to any reason, including the death of the Purchaser, the dog will be offered to the Seller first. Purchaser agrees he/she will not abandon the dog to a shelter or sell the dog, but shall contact the Seller to assist in acting as agent to rehome the dog in an approved environment. Seller will not offer a refund of any kind until the returned dog is vet checked and rehomed. Seller reserves the right to keep the original deposit in the amount of $500 and any additional vet and/or boarding fees until the dog can be rehomed. Seller will then determine the refund amount to be issued to the original buyer after receiving payment from dog's new owners. ASDR limited registration papers will be supplied and signed over to the Breeder upon surrender of the animal. Agreed to this
